This Privacy Policy explains how 3 Natives Franchising LLC (“3Natives,” “we,” “us,” or “our”) collects, uses, shares, and protects personal data when you visit 3natives.com, use our mobile app, join our rewards program, place online or catering orders, purchase gift cards, or participate in our promotions and contests. It also describes the privacy rights you may have and how to exercise them.

2. Who and What This Policy Covers
This policy applies to visitors to our website and app, rewards program members, online-ordering and catering customers, gift-card purchasers, and entrants in our promotions and contests. It does not apply to the practices of third parties we do not control, or to data handled by our individual franchisees in their separate capacities, except as described here.
3. Personal Data We Collect
Depending on how you interact with us, we may collect the following categories of personal data:
- Identifiers and contact data — name, email address, phone number, and similar identifiers.
- Account and rewards data — rewards membership details, points balances, preferences, and transaction history.
- Order and purchase data — items ordered, order history, catering details, and gift-card purchases.
- Payment data — payment is processed by our third-party ordering and gift-card providers; we do not store full payment card numbers.
- Device and online-activity data — IP address, device and browser type, cookie and pixel identifiers, pages viewed, and interactions with our site and ads.
- Approximate location — derived from your IP address or device, used to help you find nearby locations.
- Promotional content — information you submit when entering a contest or promotion (for example, your social media handle and submitted content).
4. Where the Data Comes From
We collect personal data directly from you (when you create an account, order, join rewards, contact us, or enter a promotion); automatically from your device when you use our site or app (through cookies and similar technologies); and from the service providers that operate parts of our business, such as our rewards and ordering platforms.
5. How We Use Personal Data
- To process and fulfill your orders, catering requests, and gift-card purchases.
- To operate our rewards program and provide member benefits.
- To send marketing and promotional messages (where permitted, and subject to your ability to opt out).
- To run, administer, and announce winners of promotions and contests.
- To measure and improve our website, app, products, and marketing through analytics.
- To deliver and measure advertising, including targeted advertising.
- To maintain security, prevent fraud, and comply with legal obligations.
6. Cookies and Tracking Technologies
We and our service providers use cookies, pixels, and similar technologies. These fall into categories: strictly necessary (needed for the site to function), analytics (to understand site usage), and advertising (to deliver and measure ads). Specific tools we use include Google Tag Manager and Google Analytics (analytics) and the Meta (Facebook) Pixel (advertising).

7. How We Share Personal Data
We do not share your personal data except with the following categories of recipients, for the purposes described above:
- Rewards and messaging provider — Spendgo, which operates our rewards program and sends our email and messaging communications through its Infobip integration.
- Online-ordering and gift-card providers — the third-party platforms that process your orders and gift-card purchases.
- Analytics provider — Google.
- Advertising platform — Meta.
- Legal and safety — when required by law, to enforce our terms, or to protect rights, safety, and property.
We do not exchange your personal data with these parties for their own independent marketing.
8. Targeted Advertising, “Sale,” and “Sharing”
We do not sell your personal data for money. However, our use of advertising technologies such as the Meta Pixel — which discloses identifiers and online-activity data to advertising platforms to deliver and measure ads — may be considered “targeted advertising,” a “sale,” or “sharing” of personal data under certain state privacy laws.
You have the right to opt out. You can opt out by using the “Your Privacy Choices” link in our footer, by adjusting your cookie preferences to decline advertising cookies, or by enabling a recognized universal opt-out signal (see Section 9).
9. Universal Opt-Out / Global Privacy Control
We recognize and honor the Global Privacy Control (GPC) and other recognized universal opt-out browser signals. When we detect such a signal, we treat it as a request to opt out of targeted advertising and any “sale” or “sharing” of personal data for the browser or device sending it.
10. Your Privacy Rights
Depending on your state of residence, you may have the right to:
- Access / confirm whether we process your personal data and obtain a copy of it.
- Correct inaccuracies in your personal data.
- Delete personal data we hold about you.
- Obtain a portable copy of data you provided to us.
- Opt out of targeted advertising, the “sale” or “sharing” of personal data, and certain profiling.
- Appeal a decision we make about your request.
How to submit a request. You may exercise these rights through either of two methods: (1) email us at operations@3natives.com, or (2) write to us by mail at 3 Natives Franchising LLC, 250 Tequesta Drive, Suite 200, Tequesta, Florida 33469. We will respond without undue delay and within 45 days, with one allowed extension where reasonably necessary. We may need to verify your identity before fulfilling your request. You will not be discriminated against for exercising your rights.
Appeals. If we decline your request, you may appeal by replying to our decision or emailing operations@3natives.com with “Privacy Appeal” in the subject line. If your appeal is denied, you may contact your state Attorney General.
You may use an authorized agent to submit a request on your behalf where permitted by law.
11. Rewards Program — Notice of Financial Incentive
Our rewards program offers benefits such as points, discounts, and special offers in exchange for your participation, which involves collecting personal data such as your contact details and purchase history. Participation is entirely voluntary, and you may withdraw from the rewards program at any time through the rewards app, which is operated by our provider, Spendgo. You can also unsubscribe from our marketing emails at any time using the unsubscribe link included in every email. We offer this program because the value of the personalized offers and rewards we provide is reasonably related to the value of the data you provide in connection with the program.
12. Sensitive Data
We do not seek to collect sensitive personal data (such as precise geolocation, government IDs, or data revealing characteristics like health, race, or religion) in the ordinary course. Where any processing of sensitive data would occur and consent is required by law, we will obtain it.
13. Children’s Privacy
Our website, app, and services are intended for a general audience and are not directed to children. We do not knowingly collect personal data from anyone under 13 years of age. If you believe a child under 13 has provided us personal data, contact operations@3natives.com and we will delete it.
14. Data Retention
We retain personal data only as long as reasonably necessary for the purposes described in this policy — for example, to maintain your rewards account, fulfill orders, administer promotions, comply with legal and tax obligations, and resolve disputes — after which we delete or de-identify it.
15. Data Security
We maintain reasonable administrative, technical, and physical safeguards designed to protect personal data appropriate to its nature and sensitivity. No method of transmission or storage is completely secure, however, and we cannot guarantee absolute security.
16. Data Breach Notification
If a breach of security affecting your personal data occurs, we will notify affected individuals and applicable authorities as required by law, including within the timeframes required under Florida’s Information Protection Act.
17. Third-Party Links
Our site and app may link to third-party websites and services (such as our ordering platform, gift-card provider, app stores, and social media). Their privacy practices are governed by their own policies, and we are not responsible for them.
18. Changes to This Policy
We may update this Privacy Policy from time to time. When we do, we will revise the “Last updated” date above and, where appropriate, provide additional notice. Your continued use of our services after an update means you accept the revised policy.
