3Natives $5,000 Summer Video Contest — Official Rules

NO PURCHASE NECESSARY TO ENTER OR WIN.

These Official Rules govern the 3Natives $5,000 Summer Video Contest (the “Contest”). The Contest is a skill-based contest. Winners are selected by judging on the basis of merit under the judging criteria stated in these Official Rules, not by random chance, drawing, sweepstakes, lottery, raffle, or other chance-based method. By entering, each entrant agrees to be bound by these Official Rules and by the decisions of the Sponsor and judges, which are final and binding in all matters relating to the Contest, including eligibility, compliance with these Official Rules, interpretation of these Official Rules, judging, winner selection, and prize award, subject to applicable law.

1. Sponsor

The Contest is sponsored by 3 Natives Franchising, LLC (the “Sponsor”), 250 Tequesta Drive, Suite 200, Tequesta, Florida 33469.

The Contest is in no way sponsored, endorsed, administered by, or associated with Instagram, Meta Platforms, Inc., TikTok, or any of their affiliates. Entrants release these platforms from any and all liability arising from or related to the Contest. Any questions, comments, or complaints regarding the Contest must be directed to the Sponsor, not to Instagram, Meta, or TikTok.

2. Eligibility

• The Contest is open only to legal residents of the fifty (50) United States and the District of Columbia who are eighteen (18) years of age or older at the time of entry and who meet all requirements of these Official Rules, as determined by Sponsor in its reasonable discretion.
• Employees, officers, directors, contractors, representatives, and agents of the Sponsor, its franchisees, and its parent, affiliates, subsidiaries, advertising and promotional agencies, and any other person or entity involved in the development, administration, judging, or fulfillment of the Contest, and the immediate family members (spouses, parents, children, and siblings) and household members of each, are not eligible to enter or win.
• Void where prohibited or restricted by law. Entrants are responsible for complying with all applicable federal, state, and local laws and regulations.
• Entrants must have valid, public accounts on Instagram and/or TikTok and must comply with each platform’s terms of service. Entries must be publicly viewable to be judged.

3. Contest Period

The Contest begins on July 1, 2026 at 12:00:00 a.m. Eastern Time (ET) and ends on July 19, 2026 at 11:59:59 p.m. ET (the “Contest Period”). Entries submitted before or after the Contest Period will not be eligible. Sponsor’s computer or designated timekeeping device is the official timekeeper for the Contest.

4. How to Enter

During the Contest Period, to enter, an entrant must:

1. Create an original video featuring the 3Natives Wave Bowl and Passion Glow Smoothie, which may be featured without making a purchase from 3Natives, including by using lawfully obtained product, packaging, signage, imagery, or other original content that clearly identifies the products.
2. Post the video publicly to Instagram and/or TikTok.
3. Tag @3natives and include both of the following required hashtags in the post caption: #CatchTheWave5K and #3NativesSummer. The post caption must also clearly identify the video as a contest entry (for example, by stating “Contest entry” or “Entering the 3Natives $5,000 video contest”).

No purchase necessary. A purchase, payment, store visit, or other transaction will not improve an entrant’s chance of winning and is not required to enter or win. Purchase of any 3Natives product is not required to enter or win.

• Limit: each entrant may submit up to three (3) entries during the Contest Period. Each eligible video posted in accordance with these rules counts as one entry. Entries in excess of the stated limit, duplicate entries, or entries submitted through automated, scripted, or other improper means may be disqualified in Sponsor’s sole discretion.
• Entries must be the original work of the entrant, must not infringe any third party’s rights, and must not have been previously published or submitted in any other contest.
• Entrants are responsible for ensuring their account privacy settings allow Sponsor to view the entry throughout the Contest Period and judging period. Sponsor is not responsible for entries that are not received, are lost, late, incomplete, invalid, misdirected, illegible, corrupted, deleted, filtered, blocked, removed, not publicly viewable, or cannot be viewed or verified for any reason, including due to platform settings, technical issues, or actions by any social media platform.

5. Content Requirements

Each video entry must comply with the following. Entries that fail to comply may be disqualified at Sponsor’s sole discretion:

• Must feature the 3Natives Wave Bowl and/or Passion Glow Smoothie.
• Must be the entrant’s own original content. Any music, footage, images, or other material owned by a third party may not be used without proper rights or license.
• Must not contain content that is unlawful, obscene, defamatory, harassing, hateful, sexually explicit, violent, or that disparages the Sponsor or any other person or entity.
• Must not depict illegal activity, dangerous behavior, or the consumption of alcohol, tobacco, or controlled substances.
• Must not include any identifiable third party (person, logo, trademark, music, copyrighted work, or private property) without that party’s permission and all required rights, licenses, consents, and releases. Any individual appearing in the video must consent to appearing and to the use described in these rules. Entrants must be able to provide proof of all required permissions upon Sponsor’s request.
• Must not contain personal or contact information of the entrant or any third party.

6. Judging and Winner Selection

All eligible entries will be judged by a panel of judges selected by the 3Natives Corporate Team. Sponsor may determine, in its reasonable discretion, whether an entry is eligible and complies with these Official Rules before submitting it for judging. Entries accepted for judging will be scored on the following criteria:

• Creativity and originality — 40%
• Entertainment value / overall appeal — 30%
• Brand fit and effective featuring of the Wave Bowl and Passion Glow Smoothie — 30%

The entry with the highest overall score will be selected as the potential winner, subject to verification of eligibility and compliance with these Official Rules. In the event of a tie, the entry with the highest score in the Creativity and originality category will be selected; if a tie remains, the tied entry with the highest score in the Entertainment value / overall appeal category will be selected; if a tie still remains, the judges will re-score the tied entries using the same judging criteria until one potential winner is selected. Judging decisions are final and binding. There is one (1) prize available; the selection is based on the judging criteria above and not on chance. If the potential winner is disqualified, fails verification, or forfeits the prize, Sponsor may select an alternate potential winner from the remaining eligible entries using the same judging basis.

7. Prize

One (1) winner will receive a prize of $5,000 USD, awarded by check or other payment method selected by Sponsor in its sole discretion. The approximate retail value (“ARV”) of the prize is $5,000. Total ARV of all prizes available is $5,000. No more than the stated number of prizes will be awarded, and all expenses not expressly stated in these Official Rules are the sole responsibility of the winner.

• The prize is awarded “as is” with no warranty or guarantee, express or implied. The prize is non-transferable and no substitution or cash equivalent is permitted except at Sponsor’s sole discretion.
• Taxes are the sole responsibility of the winner. Because the prize value is $600 or more, the winner will be required to complete and return an IRS Form W-9 before the prize is released, and the Sponsor will issue an IRS Form 1099 reporting the prize value. The winner is responsible for all federal, state, and local taxes.

8. Winner Notification and Announcement

The potential winner will be notified on or about July 20, 2026 by direct message to the Instagram and/or TikTok account used to enter only from 3Natives official channels. The potential winner must respond within five (5) days of notification and complete, sign, and return the documents described in Section 9, and must otherwise cooperate with Sponsor’s verification of identity, eligibility, ownership and rights in the Entry, and compliance with these Official Rules. If a potential winner cannot be reached, fails to respond within the required period, fails to complete verification, declines the prize, is found ineligible, or is otherwise not in compliance with these Official Rules, the prize may be forfeited and awarded to an alternate entrant selected on the same judging basis.

The winner may be publicly announced on or after July 20, 2026 via Sponsor’s social media channels and other marketing materials.

9. Winner Verification and Release Documents

Before the prize is awarded, the potential winner must complete, sign, and return the following within the required response period:

• An Affidavit of Eligibility confirming compliance with these Official Rules;
• A Liability Release and, where lawful, a Publicity Release; and
• An IRS Form W-9.

Failure to return any required document within the required period may result in forfeiture of the prize.

10. Content License and Publicity Rights

By entering, each entrant grants the Sponsor and its designees a non-exclusive, worldwide, royalty-free, fully paid, transferable, sublicensable, perpetual, irrevocable license to use, reproduce, edit, modify, adapt, publish, repost, display, distribute, perform, transmit, and create derivative works from the entrant’s submitted video (the “Entry”), in whole or in part, and the entrant’s name, likeness, voice, image, social media handle, statements, and biographical information, in any and all media now known or hereafter developed, including Sponsor’s owned channels, paid media, advertising, promotional materials, public relations, and other commercial purposes, without further notice, compensation, review, or approval, except where prohibited by law.

Each entrant represents and warrants that they own or control all rights in the Entry, that the Entry is original, that the Entry does not infringe, misappropriate, or otherwise violate any right of any third party, and that the use of the Entry by Sponsor as described will not infringe, misappropriate, or otherwise violate the rights of any third party. Each entrant is responsible for obtaining any rights, licenses, consents, and releases from individuals appearing in the Entry and from any owners of content, music, footage, images, trademarks, locations, or other materials included in the Entry. Each entrant agrees to indemnify, defend, and hold harmless the Released Parties from and against any claims, demands, losses, damages, liabilities, costs, and expenses, including reasonable attorneys’ fees, arising out of or relating to the Entry, any breach or alleged breach of these representations and warranties or these Official Rules, or any violation or alleged violation of any third-party rights.

Except where prohibited, entry constitutes the entrant’s consent to the Sponsor’s use of the entrant’s name, likeness, voice, social media handle, and Entry for advertising and promotional purposes without additional compensation.

11. General Conditions

Sponsor reserves the right, in its sole discretion, to disqualify any entrant or entry that Sponsor finds or reasonably suspects to be tampering with the entry process or the operation of the Contest, acting in violation of these Official Rules or any applicable platform terms, submitting false, misleading, incomplete, or unverifiable information, using multiple accounts or automated, scripted, robotic, or other improper means, interfering with the Contest, infringing or violating third-party rights, or acting in an unsportsmanlike, disruptive, abusive, threatening, or unlawful manner.

If the Contest is not capable of running as planned for any reason, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, platform outage or policy change, legal or regulatory restriction, force majeure event, public health event, natural disaster, acts of war or terrorism, civil disturbance, labor dispute, supply or payment disruption, or any other cause beyond Sponsor’s reasonable control that corrupts or affects the administration, security, fairness, integrity, or proper conduct of the Contest, Sponsor reserves the right, in its sole discretion and subject to applicable law, to cancel, terminate, modify, or suspend the Contest. If Sponsor cancels, terminates, modifies, or suspends the Contest, Sponsor may, in its sole discretion, select the winner from among eligible, non-suspect entries received before the action taken, using the judging criteria stated in these Official Rules, or take any other action Sponsor determines is fair and appropriate under the circumstances.

12. Release and Limitation of Liability

By entering, each entrant agrees to release and hold harmless the Sponsor, its franchisees, and its parent, affiliates, subsidiaries, advertising and promotional agencies, prize suppliers, judges, social media platforms, and the officers, directors, employees, contractors, representatives, and agents of each (the “Released Parties”) from any and all claims, liability, injury, death, loss, or damage of any kind, including attorneys’ fees, arising from or in connection with participation in the Contest, creation, submission, posting, publication, or use of an Entry, Sponsor’s exercise of rights granted under these Official Rules, winner selection or disqualification decisions, prize acceptance, receipt, possession, use, or misuse, or any technical, platform, or administrative issue relating to the Contest, except to the extent prohibited by law.

The Released Parties are not responsible for any incorrect or inaccurate information, technical failures, or any error, omission, interruption, deletion, defect, or delay in operation or transmission relating to the Contest.

13. Disputes and Governing Law

Except where prohibited, all issues and questions concerning these Official Rules and the Contest shall be governed by the laws of the State of Florida, without regard to conflict-of-law principles, and any disputes shall be resolved exclusively in the state or courts located in Palm Beach County, Florida. Each entrant consents to the personal jurisdiction and venue of those courts. To the fullest extent permitted by law, each entrant agrees that any dispute, claim, or cause of action arising out of or relating to the Contest or these Official Rules will be resolved individually, without resort to any form of class, collective, consolidated, representative, or private attorney general action, and waives any right to a jury trial. In any such dispute, each entrant’s recovery will be limited to actual out-of-pocket costs of entering the Contest, if any, and will not include attorneys’ fees, punitive, incidental, consequential, special, or indirect damages, except where prohibited by law. Nothing in this section limits Sponsor’s right to seek injunctive or equitable relief for misuse of Sponsor’s intellectual property, violation of these Official Rules, or conduct affecting the administration, security, fairness, integrity, or proper conduct of the Contest.

14. Privacy

Information collected from entrants is subject to the Sponsor’s Privacy Policy, available at https://3natives.com/privacy-policy/. Information submitted through Instagram or TikTok may also be subject to the applicable platform’s privacy policy and terms.

15. Winner List

To request the name of the winner, send a self-addressed stamped envelope by August 20, 2026 to: 3 Natives Franchising, LLC, 250 Tequesta Drive, Suite 200, Tequesta, Florida 33469, Attn: $5,000 Summer Video Contest Winner List.
